Wynn Casino Blackjack Dealer Continued to Deal Cards While Player Suffered Heart Attack

The Wynn Las Vegas has been hit by a lawsuit alleging that a blackjack dealer continued dealing cards while a man was having a cardiac arrest at the table, the victim later dying from related causes.

Florida attorney, David Jagolinzer, was in Vegas for the annual legal conference, Mass Torts Made Perfect, when he suffered the heart attack on April 6th last year while playing blackjack.

But according to the lawsuit filed last week, he was slumped over the table for more than 15 minutes before staff made any attempt to help him.

During that time, it is alleged that the dealer continued to deal cards to another player and even counted Mr Jagolinzer’s chips instead of going to the clearly ill man’s aid.

Attorneys for Jagolinzer claim that Wynn security witnessed the incident on live CCTV and did nothing. The legal complaint also states that when Wynn employees eventually attempted to use a defibrillator on Jagolinzer – some 20 minutes after he first slumped at the table – they didn’t know how to properly operate it.

Mr Jagolinzer died on October 18th last year, some 6 months after his heart attack, the cause of death recorded as anoxic encephalopathy related to cardiac arrest.

Attorneys for Mr Jagolinzer’s family claim that his death could have been avoided had he “obtained timely emergency medical treatment.”

“David dedicated his life to helping those in need and always fighting for justice. There are no words to describe the trauma we endured as a family this last year losing him,” his family said in a statement. “His death was a devastating tragedy that could have been prevented.”

Christian Morris, an attorney for the family, stated in an email to the Las Vegas Review Journal newspaper:

“The family needs to know how and why casino security observes every player at a card table and will intervene if they think you are trying to cheat the house, but let David remain slumped over and unconscious on a gaming table while his brain was being deprived of oxygen.”

The lawsuit alleges wrongful death, negligence, negligence in security and negligence in training and hiring.
In a statement, Wynn Resorts said it would strongly defend itself against the false allegations made in the lawsuit.
