Mike Postle’s Attorney Files Motion to Exit Case, Citing Compliance and Communication Failures

The attorney representing alleged poker cheat Mike Postle in Postle’s libel suit against his most prominent accusers has filed a motion to be relieved of his duty as Postle’s legal representative. Steven T. Lowe, of the Beverly Hills (CA) based Lowe & Associates, filed the motion and a supporting declaration of cause on Tuesday, December 8, 2020, to the Sacramento Superior Court where early stages of the case are ongoing.

Lowe’s filing states this as the reason for seeking to be relieved from the case:

“Client [Postle] has failed to comply with the written agreement between the firm and the client, and communication has otherwise ceased between the client and attorney.”

Postle filed a $330 million defamation case against a dozen separate defendants in early October, following the dismissal earlier this year of a fraud lawsuit brought by 86 allegedly cheated players against Postle and two co-defendants, including Sacramento’s Stones Gambling Hall. The notice of Lowe’s filing his removal request was posted publicly by gaming attorney Maurice “Mac” VerStandig, who declined further comment. VerStandig’s firm represented Veronica Brill and the dozens of other players who sought compensation for Postle’s alleged cheating activities.

The lead plaintiff in the earlier case, whistleblower Veronica Brill, is among the 12 defendants in Postle’s countering action. The other 11 defendants, however, are generally high-profile and deep-pocketed individuals or entities who offered negative commentary on Postle and the alleged cheating during dozens of the Stones’ Gambling Hall’s livestreamed cash games.

Those other defendants in Postle’s libel suit include: ESPN, PokerNews.com (iBus Media Limited), Joey Ingram, Haralabos Voulgaris, Daniel Negreanu, Todd Witteles, Upswing Poker (associated with Doug Polk), Seat Open LLC, Jonathan Little Holdings LLC, Solve for Why Academy LLC and Run it Once, Inc. (associated with Phil Galfond).

Lowe’s motion to be relieved from representing Postle will be ruled upon on January 14, 2021, before presiding California Superior Court judge Richard K. Sueyoshi. All other activity in the case will likely be put on hold until the matter of Postle’s representation is resolved. Assuming Lowe’s motion to depart is approved, Postle could retain new legal counsel, attempt to represent himself as a pro se plaintiff, or simply drop the case.
